Terms of Service

1. Acceptance of Terms
By downloading, installing, or using the Bloom app ("Platform", "we", "us"), you agree to be bound by these Terms of Service ("Terms").
These Terms form a binding legal agreement between you and Chromesque, LLC. Use of the Platform also constitutes acceptance of our Privacy Policy and Terms of Service, which is incorporated here by reference.
2. Eligibility & Accounts
2.1 Age Requirement
You must be at least 13 years old to use the Platform. Users under 18 must have parental or guardian consent. By using the Platform, you represent that you meet these requirements.
2.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.
2.3 One Account Per Person
Each person may hold one account. Creating multiple accounts to circumvent restrictions, refund limits, or bans is prohibited and may result in permanent termination of all associated accounts.
3. User Roles
The Platform supports two account types:
- Subscriber — a user who discovers, subscribes to, and consumes collections.
- Creator — a user who publishes and manages collections on the Platform.
A single user account may switch between roles. Role-specific terms are noted where applicable.
4. Credits & Payments
4.1 Credit System
The Platform uses a virtual credit system. Credits cannot be transferred to other users on the platform. Credits are used to subscribe to paid collections and unlock individual content items within the Platform.
4.2 Purchasing Credits
Credits are purchased through in-app purchase (IAP) via the Apple App Store or Google Play. All purchases are subject to the payment terms of the respective store. The Platform does not directly process payment card data.
4.3 Creator Earnings
Creators earn credits when subscribers pay to access their collections or unlock individual content items. Earned credits represent a balance on the Platform and are subject to the Platform's payout and settlement policies.
4.4 Ad-Reward Credits
Subscribers and creators may earn bonus credits by engaging with rewarded advertisements within the Platform. Ad-reward credit amounts are determined by prevailing advertising rates and may change without notice. The Platform makes no guarantee as to the availability or rate of ad-reward credits.
4.5 Credit Expiry
Purchased credits do not expire while your account remains active. Earned credits are subject to the Platform's arrears and settlement rules described in Section 7. Upon account termination, any remaining credit balance is forfeited.
5. Subscriptions & Refund Policy
5.1 Subscribing to a Collection
When a subscriber subscribes to a paid collection, credits are immediately deducted from their account and credited to the creator. The subscription is confirmed upon successful credit deduction.
5.2 Refund Eligibility
Subscribers may request a full refund within 3 calendar days of their original subscription date, subject to all of the following conditions:
- The subscription is no more than 3 days old at the time of the cancellation request.
- The collection was a paid subscription (free subscriptions receive no credits back).
- The subscriber has not purchased access to any individual locked content items within the collection.
If all conditions are met, the full subscription credit amount is refunded to the subscriber's purchased credits balance.
5.3 Content Unlock Credits
Credits spent to unlock individual content items within a collection are non-refundable under any circumstances, including subscription cancellation or collection deletion. Unlocking content is a separate, irrevocable transaction.
5.4 No Refund After Grace Period
After the 3-day grace period, no refunds are issued for any reason, including:
- Dissatisfaction with content
- Change of mind
- Technical issues on the subscriber's device
- Partial completion of the collection
6. Subscription Cancellation & Archival
6.1 Soft Cancellation
Cancelling a subscription does not permanently delete a subscriber's progress. Progress records, completed content, and unlocked items are preserved under an archived subscription.
6.2 Re-Subscribing
If a subscriber re-subscribes to a collection after cancelling, their previous progress and unlocked content are restored. They will be charged the standard subscription price again (if the collection is paid), unless the re-subscription falls within the refund window of the original subscription.
6.3 Continued Access to Unlocked Content
Individually unlocked content items remain accessible even after subscription cancellation for the lifetime of the collection, provided the collection has not been deleted by the creator.
7. Creator Obligations & Collection Deletion
7.1 Automatic Refund on Deletion
If a creator deletes a collection within 3 days of a subscriber's subscription, the subscriber is automatically refunded the full subscription amount. This applies independently of any individual content unlocks the subscriber may have made.
7.2 Creator Deductions
When a refund is triggered by collection deletion, the refund amount is deducted from the creator's account in the following priority order:
- Earned credits (credits earned from content, ADS, withdrawable equivalent) — drawn first.
- Purchased credits (IAP/top-up credits, non-withdrawable) — drawn if earned credits are insufficient.
- Arrears — if neither credit pool covers the full refund amount, the remainder is recorded as an arrears balance against the creator's account.
7.3 Arrears Settlement
An arrears balance represents a debt owed by the creator to the Platform. Arrears are settled automatically from the next incoming earned credits and from any credit top-up purchase, before either is credited to the creator's account. Creators with an outstanding arrears balance will see a reduced or zero net payout until the arrears are fully settled.
7.4 Content Standards
Creators are solely responsible for all content they publish. By publishing a collection, creators represent and warrant that their content does not infringe any third-party intellectual property, privacy, or publicity rights; does not contain illegal, harmful, defamatory, or obscene material; and is accurate and not deliberately misleading. The Platform reserves the right to remove any content and terminate any creator account that violates these standards, without prior notice and without refund.
8. Intellectual Property
8.1 Platform IP
All Platform software, design, branding, and technology are the exclusive property of Chromesque, LLC. Nothing in these Terms grants you any ownership rights in the Platform.
8.2 Creator Content
Creators retain ownership of the content they publish on the Platform. By publishing content, creators grant the Platform a non-exclusive, worldwide, royalty-free licence to host, display, and deliver that content to subscribers for the purpose of operating the Platform.
8.3 Subscriber Use
Subscribers are granted a limited, personal, non-transferable licence to access and view content they have subscribed to or unlocked, solely for personal, non-commercial use. Downloading, recording, redistributing, or reselling any Platform content is strictly prohibited.
9. Prohibited Uses
You may not use the Platform to:
- Violate any applicable law or regulation.
- Impersonate another person or misrepresent your affiliation with any entity.
- Upload, distribute, or transmit malicious code, spam, or unauthorised advertising.
- Attempt to gain unauthorised access to the Platform's systems or another user's account.
- Reverse-engineer, decompile, or disassemble any part of the Platform.
- Use automated tools (bots, scrapers, crawlers) to access or collect data without our prior written consent.
- Circumvent, disable, or interfere with any security or content-protection feature of the Platform.
10. Notifications
Subscribers and creators receive push and in-app notifications for subscription confirmations, refunds, cancellations, new content, and earned credit events. You may manage notification preferences in the Platform's Settings. Disabling notifications does not affect your rights or obligations under these Terms.
11. Account Suspension & Termination
11.1 Termination by You
You may delete your account at any time from the Platform's Settings. Upon deletion, your access to all collections and content is immediately revoked and any remaining credits are forfeited.
11.2 Termination by the Platform
The Platform may suspend or permanently terminate your account at any time, with or without notice, if you violate these Terms, engage in conduct harmful to other users or the Platform, or fail to settle an outstanding arrears balance after reasonable notice.
11.3 Effect of Termination
Upon termination, all licences granted to you under these Terms immediately cease. The Platform is not liable for any loss resulting from account termination.
12. Liability & Limitation of Damages
12.1 Platform Role
The Platform acts as an intermediary between creators and subscribers. The Platform does not create, curate, or guarantee the quality of any collection content and is not responsible for a creator's failure to maintain or update their collections.
12.2 Service Availability
The Platform is provided "as is" and "as available". We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
12.3 Maximum Liability
To the maximum extent permitted by applicable law, the Platform's total liability to any user for any claim arising out of or related to the use of the Platform shall not exceed the total credits transacted by that user in the 30 days preceding the claim.
12.4 No Consequential Damages
The Platform shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, even if advised of the possibility of such damages.
12.5 User Responsibility
Users are solely responsible for maintaining the security of their account credentials, ensuring their device meets the Platform's minimum requirements, and compliance with applicable local laws regarding online purchases and digital content.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration in New York, NY, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for matters involving intellectual property or unauthorised access.
14. Amendments
The Platform reserves the right to update these Terms at any time. Material changes will be communicated via in-app notification at least 7 days before taking effect. Continued use of the Platform after the effective date of any change constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and delete your account.
